This website is operated by Mudlust Ceramics, based in New Brunswick, Canada. Throughout this site, the terms “we,” “us,” and “our” refer to Mudlust Ceramics.

By visiting our website, purchasing from us, or using any part of our site, you agree to these Terms of Service. If you do not agree with these terms, please do not use the website or purchase our products.

1. Our Products

Mudlust Ceramics creates handmade ceramic goods, sculptural artwork, commissioned pieces, and digital pottery templates.

Because our physical products are handmade, minor variations in shape, colour, glaze, texture, size, surface, and finish are normal and are part of the handmade nature of the work.

Product photos are intended to represent items as accurately as possible, but screen settings, lighting, glaze variation, and firing conditions may affect appearance.

2. Physical Ceramic Products

All ceramic items are handmade and may contain minor irregularities that are not considered defects.

Unless otherwise stated, functional pottery is intended for normal household use. Customers are responsible for following any care instructions provided with the product or listing.

We are not responsible for damage caused by misuse, improper care, thermal shock, impact, commercial use, or use inconsistent with the intended purpose of the item.

3. Digital Pottery Templates

Digital products are delivered electronically and are not physical goods.

Due to the nature of digital products, all digital template sales are final once the files have been delivered or downloaded, except where required by law.

Digital pottery templates are licensed for personal and small-business use unless otherwise stated.

You may use our templates to create and sell finished ceramic pieces.

You may not:

• resell, redistribute, share, upload, or give away the digital template files;

• reproduce our templates for resale;

• claim the template design itself as your own;

• include our template files in classes, memberships, bundles, downloads, or other digital products without written permission.

All

intellectual property rights in the digital templates remain with Mudlust Ceramics.

4. Commissioned and Custom Work

Commissioned work may require a deposit before production begins.

Deposits on custom or commissioned work may be non-refundable once design or production work has begun.

Because handmade ceramics involve kiln firing, glaze chemistry, and other variables, exact replication of reference images, colours, glaze effects, dimensions, or previous pieces cannot be guaranteed.

We reserve the right to make reasonable artistic and technical decisions during production.

Completion dates are estimates unless otherwise agreed in writing.

5. Pricing and Payment

All prices are shown in the currency displayed on the website at checkout.

Prices may change at any time without notice.

Customers are responsible for any applicable shipping charges, taxes, duties, customs fees, import charges, brokerage fees, or other charges unless expressly stated otherwise at checkout.

We reserve the right to correct pricing errors and cancel orders placed at an incorrect price.

6. Shipping

Shipping times shown on the website are estimates only and are not guaranteed.

Once an order has been transferred to the shipping carrier, delivery times are outside our direct control.

Customers are responsible for providing a complete and accurate shipping address.

Mudlust Ceramics is not responsible for delays caused by customs, carriers, weather, incorrect addresses, or circumstances outside our reasonable control.

If a package is returned because of an incorrect or incomplete address, the customer may be responsible for additional shipping charges.

7. Damage in Transit

We carefully package ceramic items for shipment.

If an item arrives damaged, contact us as soon as possible and provide clear photographs of:

• the damaged item;
• the packaging;
• the shipping box;
• the shipping label.

We may require this information in order to file a claim with the carrier.

Depending on the circumstances, we may offer a replacement, repair, store credit, or refund.

Do not discard damaged items or packaging until the claim has been resolved.

8. Returns and Exchanges

Returns of physical products are accepted only in accordance with our posted Return and Refund Policy.

Custom, commissioned, personalized, sale, clearance, studio-second, and digital products may be final sale unless otherwise stated or required by law.

Returned items must be received in their original condition.

Customers may be responsible for return shipping costs unless the item arrived damaged, defective, or incorrect.

9. Studio Seconds

Items sold as “studio seconds” may contain known cosmetic or functional imperfections that are disclosed in the product description.

By purchasing a studio second, the customer acknowledges and accepts the disclosed condition of the item.

Studio-second items are generally final sale.

10. Intellectual Property

All website content, including product designs, photographs, videos, text, graphics, logos, artwork, digital templates, and branding, is owned by or licensed to Mudlust Ceramics unless otherwise stated.

You may not reproduce, distribute, publish, sell, modify, or commercially use our content without prior written permission.

11. Website Use

You agree not to use our website:

• for unlawful purposes;
• to violate intellectual property rights;
• to transmit harmful code or malware;
• to interfere with the operation or security of the website;
• to attempt unauthorized access to accounts, systems, or data.

We reserve the right to refuse service, cancel orders, or restrict access where reasonably necessary.

12. Third-Party Services

Our website may use third-party services, including Shopify, payment processors, shipping providers, analytics platforms, social media platforms, and other service providers.

Your use of those services may also be subject to their own terms and policies.

We are not responsible for the operation, availability, or actions of third-party services.

To the fullest extent permitted by applicable law, Mudlust Ceramics will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website or products.

Our total liability relating to any purchase will not exceed the amount paid for the product giving rise to the claim.

Nothing in these terms limits rights that cannot legally be excluded under applicable consumer protection laws.

14. Indemnification

You agree to indemnify and hold Mudlust Ceramics harmless from claims, damages, losses, or expenses arising from your misuse of the website, products, digital files, or violation of these Terms of Service.

Continued use of the website after changes are posted constitutes acceptance of the revised terms.
